“Life In Varick” Survey:  Susan Ottenweller reviewed the results of the “Life in Varick” survey.  She reported that 76 total responses were collected with over 1,100 surveys mailed.  She noted that the survey monkey program that was used went down the second day of collection so only 13 surveys were received by using that system.  The recurring themes in this survey were that residents value communication, protecting lake water quality, concerns about short term rentals and solar farms.

A discussion was held regarding posting items of interest regarding town business on the town’s web.  It was noted that the Planning Board currently has this on their agenda, along with posting on the town’s FACEBOOK page.  The board noted their appreciation of the work the Planning Board does and identified they should not be required to perform these duties. Mr. Riegel will investigate finding someone who might be interested in keeping the web page up to date and report back at the next meeting.

With regards to protecting lake water quality, the board is currently working on a new sewer project along State Route 89 and East Lake Road currently has a municipal sewer line.

Cindy Lont prepared a written description of the work completed to date on zoning regarding Short Term Rentals which has been offered for posting on the town’s Webpage. It was also reported that the Planning Board is currently reviewing the code pertaining to solar farms. The Town Board, Planning Board and the Zoning Board of Appeals continue to review and improve zoning in the Town of Varick and will continue to address the concerns presented by Town of Varick residents. A copy of the written report submitted by the Survey Group consisting of Thomas Bjorkman, Donna Karlsen, Cindy Lont, Eric Riegel and Susan Ottenweller will be filed with the official minutes.

Abstract:  A motion by Richard McCulloch, seconded by James Velie and so carried unanimously to approve Abstract No. 9, Vouchers 263 to 293 in the amount of $210,781.34.

Highway:  Ben Freier reported that the department will be helping the Town of Seneca Falls and Seneca County with paving and milling the next two weeks.  He reported he is waiting to see what he has left in CHIPS funding prior to determining what road work he will complete by the end of the year.

Attorney Bove reported that he continues to work with the county attorney to secure an Intermunicipal Agreement with Seneca County on the McDuffey Town Road Culvert Replacement Project.  Mr. Freier reported that the funding from NYSDOT has been authorized and Barton & Loguidice will begin design work on the project.

Judge:  It was reported that the court would like to apply for a JCAP Grant for a metal detector system and new desks for their office and asked the board to support said application.

Varick Sewer District No. 1:  Effort continues receiving further pricing on the installation of the generators for this district.

Varick Sewer District No. 2:  Nothing further to report.

Varick Water District No. 1:  Nothing further to report.

Proposed Capital Project:  Pat Nicoletta from MRB informed the board that it was recommended by Mary Chappel, the town’s financial adviser, that the board move forward with the steps of formation for this district per the following:

  1. WIIA Award Letter is dated 12/19/25 and outlines that EFC wants an SRF loan application by 5/29/26.  We did not make this date since the district formation was not done.  Unfortunately, EFC does not hold the grant awards open forever.  I except EFC to give you a 1-year extension on this, but that means that we will need to file an application by 5/29/27 or thereabout.
    1. We want to lock this funding in as soon as possible.  Which means we need to put in a full loan application for the loan portion & be able to close on EFC grant & loan funding in 2027.  Putting in the application & providing EFC with any additional information they request is what locks in the loan fund.   FYI – The short-term funding is good for 5 years and may be extended if your bond counsel agrees.  Long-term funding would be for 30 years at 0% interest.
  1. As of the 2026 IUP listing  (Attached), the Town is eligible for 0% interest on a loan with EFC.  I believe the same will be true in the 2027 IUP but will need to verify it once it comes out.  If we close only on the WIIA grant in 2027 and do not close on 0% interest EFC loan funding, then we will not be able to close on any loan funding until the project is complete.  This means you would have to borrow the funding on the public market at the current interest rate rather than 0% interest.
  1. This is why we are recommending that the Town form SD#4 through board vote and permissive referendum at the project “most likely” case cost per EDU of $1,010 .  This happens to be the highest amount per user that the Comptroller will allow the district to be formed at and not have to ask permission to form the district.  I’d like the Town to start this process as soon as possible since it takes some time for go through the district formation process.  I’d also like the process to start in 2026 so we the Town is at the 2026 Comptroller threshold for Town districts.
    1. While I would like to say that the same amount or higher would be used by the Comptroller in 2027, history has shown that is often not the case, and the threshold drops for no reason any of us can figure out.  If the district is formed in 2027 and the cost per EDU drops, it is likely the Town will have to file an application with the Comptroller for approval to form the district.  This process has been taking about a year.  A year that will likely impact your ability to close an EFC 0% loan.

Supervisor Hayssen reminded the board that the district will not be able to move forward until the Town of Fayette continues pursuing funding or Seneca County Water Authority considers completing a transmission line through the Town of Fayette to Seneca Falls treatment plant.

Seneca Lake Water District: Nothing further to report.

Varick Water District No. 3: Nothing further to report.

Varick Water District No. 4: The board discussed the bills submitted by the Town of Fayette that reflect water billing that go back to 2022 and 2023.  The board is not in favor of paying these bills as the Varick Town 2022 and 2023 books are closed and balanced with the state comptroller’s office and the Town of Fayette was reminded multiple times that these bills had not been submitted during those time frames. It was noted that the Town of Varick went so far as to create the bill inhouse during the years of 2022 and 2023 and issued payment to the Town of Fayette for those bills.

Town Clerk: A motion by Richard McCulloch, seconded by James Velie and so carried unanimously to approve the August 2026 Town Clerk’s Report, Supervisor: $315, Total Disbursements: $315.

Minutes:   A motion by Eric Riegel, seconded by Richard McCulloch and so carried unanimously to approve the minutes of August 4, 2026.

Assessor:     Anne Morgan reported that the State Program continues to present problems.  She reported that the school tax bills were all printed for the surrounding school districts but are not correct.  Romulus Central School mailed out the bills prior to recognizing the errors and are asking the taxpayers not to pay these bills at this time.  She reported that the school districts will be reprinting new bills once the error in the program can be rectified.  Mrs. Morgan reported that a news release will be sent informing the taxpayers of this error.  It was noted that once the school publishes a news release a one-call can be made through the town if necessary.

Mrs. Morgan reported that she will be teaching a class educating people who wish to apply for an agricultural exemption on how to complete the forms.  She also noted that due to the error in the state system, the total assessments for the town and equalization rates are not correct at this time, which affects competing the 2027 budgets.

Personnel:  Melody Collinsworth submitted a written 2026 Summer Recreation Report for the board’s review.  She reported that 44 children signed up with an average of 30 children attending daily.  She outlined the activities that were held and noted that she developed a Romulus/Varick Summer Rec site on Facebook if anyone was interested in seeing pictures of the daily activities and events.

Planning Board:  Mrs. Mastellar reported that Code Enforcement Officer, Tim Dorn presented a report at their last meeting.  She also reported that their board will be moving forward with the review of solar farm zoning.

The board received a final draft of the proposed amended zoning code and approved the document as submitted.  Seneca County Planning Board will need to review the amendments for their recommendations.  Once this has been completed, the board will move forward with scheduling a public hearing.

A motion by Richard McCulloch, seconded by James Velie and so carried unanimously to send the amended code to Seneca County Planning Board for their review and recommendations.

New Business, Old Business Correspondence: Supervisor Hayssen reported that he received a letter from DEC regarding the National Flood Insurance Program, Flood Insurance Rate Map Revision and the town’s participation in the National Flood Insurance Program (NFIP).  NYSDEC’s Floodplain Management program wants to ensure that the Town of Varick maintains continued program eligibility.  They have provided a model local law that is designed to comply with the floodplain management requirements of the National Flood Insurance Program.  Once the town drafts the local law it must be reviewed by NYSDEC office prior to approval by FEMA.  Attorney Bove has prepared the draft local law and requested authority to present it to NYSDEC for approval.

A motion by Eric Riegel, seconded by Richard McCulloch and so carried unanimously to present the draft local law for Flood Damage Prevention as authorized by the New York Sate Constitution Article IX, Section 2 and Environmental Conservation Law, Article 36 to DEC.

If the draft law is approved by DEC and sent back in time, it was recommended by the town attorney that this also be sent to the Seneca County Planning Board for their review at their September board meeting.

A motion by Eric Riegel, seconded by Richard McCulloch and so carried unanimously to submit the local law pertaining to the Floodplain to the Seneca County Planning Board for their review once approved by DEC.

A motion by Eric Riegel, seconded by Jim Velie and so carried unanimously to adjourn the meeting at 8:55 p.m.

Respectfully submitted:

Donna Karlsen

Varick Town Clerk
